Can I form a US company without living in the US?
Yes. You can form a US company from anywhere in the world. You don't need to live in the US, hold a US visa or have a US tax ID, and your EIN application is included either way.
Yes. You can form a US LLC or C-Corp from any country. You don't need to live in the US, hold a US visa, or have an SSN or ITIN.
What changes when you live outside the US
- Residence. You choose the country you live in from a searchable list. Living outside the US is completely fine.
- Operating location. If you'll run the company from outside the US, or you don't know yet, choose Outside the US / not sure.
- EIN. Your EIN (tax ID) application is included with or without an SSN. Without an SSN, the IRS only accepts the application on paper. See Do I need an SSN to get an EIN?
- Address. You don't need a US address. Your registered agent's address can serve as your company's business and mailing address. See How to set your company address and confirm your phone
- Your own address. Your home address uses fields for State, province or region and Postal code. No postal code where you live? Enter 00000.
- Registered agent. Ours is included for your first year, so your company has an official address in the state you form in.
One thing to know about S-Corp status
If any owner isn't a US person for tax purposes, the app shows this note: a company with an owner who isn't a US person can't elect S-Corp status, and an election made anyway is void. It doesn't affect anything you do during formation.
